Vivek Ramaswamy raised quite a few eyebrows during the second GOP debate on Wednesday, when he declared that he advocates ending the “US citizenship at birth” rule for children born to “illegal immigrants”. The 2024 Presidential elections candidate, Ramaswamy drew a lot of flak on social media for this comment.

Calling for an end to the applicability of “US citizenship at birth” rule for children born to “illegal immigrants”, Ramaswamy had cited the 14th amendment.

“I favour ending birthright citizenship for the kids of illegal immigrants in this country,” Ramaswamy had said.

“Now, the left will howl about the Constitution and the 14th Amendment. The difference between me and them is I’ve actually read the 14th Amendment,” added Ramaswamy.

During the debate, Ramaswamy had highlighted how a Mexican diplomat’s kid even if born in the United States is not eligible to become a US citizen as per the rules under 14th Amendment.

“What it says is that all persons born or naturalized in the United States and subject to the laws and jurisdiction thereof are citizens. So nobody believes that the kid of a Mexican diplomat in this country enjoys birthright citizenship,” said Ramaswamy.

Here is a brief idea of the US laws concerning “citizenship at birth” and the 14th Amendment

According to the official US government website for “US Citizenship and Immigration Services”, the general requirement for acquisition of citizenship at birth is: “a person born in the United States who is subject to the jurisdiction of the United States is a U.S. citizen at birth, to include a child born to a member of an Indian, Eskimo, Aleutian, or other aboriginal tribe.”

The “US citizenship at birth” is applicable through the 14th Amendment to the U.S. Constitution. The section 1 of the 14th amendment states that “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”

However, the 14th Amendment also rules that children born to diplomats and other recognised government officials from foreign countries, won’t get US citizenship even if born in America.

Washington: Continuing his proposals of harsh policy changes, Indian-American presidential aspirant Vivek Ramaswamy, in his second Republican presidential debate, has said he would favour ending birthright citizenship for children of illegal immigrants in the US.
The second Republican debate of the 2024 election cycle which was held at Ronald Reagan Presidential Library and Museum in Simi Valley, California on Wednesday, saw Mr Ramaswamy sharing the stage with six other candidates including Florida Gov. Ron DeSantis and former United Nations Ambassador Nikki Haley.

When asked “what legal premise” he would use to expel undocumented immigrants and their American-born children from the country, Vivek Ramaswamy, the son of Indian immigrants, resurrected a 2015 proposal of ending birthright citizenship from then-candidate Donald Trump, reported the Washington Post on Wednesday.

The first section of the citizenship clause of the US Constitution’s 14th Amendment says, “All persons born or naturalised in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”

Although most agree with the long-held tradition that it grants citizenship to those born on US soil, some legal scholars argue that the phrase “and subject to the jurisdiction thereof” seems to give the government some leeway to restrict the right, just as other constitutional principles can be limited, the report said.

Because of this, he argued, children of undocumented immigrants born in the United States should not be granted citizenship, because their parents “broke the law” to be in the country.

Vivek Ramaswamy, 38, also supported his opponents onstage and acknowledged other measures such as militarisation of the southern border, defunding “sanctuary cities,” and an end to foreign aid to Mexico and Central America.

He said he would go a “step further” by ending “birthright citizenship for the kids of illegal immigrants in this country.” A second-generation Indian-American, Mr Ramaswamy, had earlier criticised the H-1B visa programme saying the current “lottery” system needs to be “gutted” and replaced with a “meritocratic” skill-based immigration scheme to match the needs of the US.

The H-1B visa, much sought-after among Indian IT professionals, is a non-immigrant visa that allows US companies to employ foreign workers in speciality occupations that require theoretical or technical expertise.

Vivek Ramaswamy Says Will Pardon Jan 6 Protesters If Elected US President

Washington: Republican presidential candidate Vivek Ramaswamy has vowed that he will pardon all peaceful January 6 protesters if he gets elected as the next US president in 2024.
The 38-year-old Indian American entrepreneur has gained traction after he denounced the US Justice Department for its “political persecution” of non-violent protesters at the Republican primary presidential debate last month.

“America now has a two-tiered justice system: Antifa and BLM rioters roam free while peaceful January 6 protesters are imprisoned without bail. Biden’s ‘Department of Injustice’ has executed over 1,000 arrests for nonviolent offenses related to January 6, casting a dark shadow over Lady Justice and the foundational principles of our legal system,” he said in a statement.

“To unify this country, I commit as president to pardon all Americans who were targets of politicised federal prosecutions and those denied due process. This includes all peaceful, nonviolent January 6 protesters who were denied their constitutional due process rights,” he said on Wednesday.

The January 6 riot saw more than 2,000 people enter the US Capitol as lawmakers certified the results of the 2020 election, in which President Joe Biden defeated Donald Trump.

The mob stormed the Capitol following a speech from Trump, who was speaking at a rally not far from the Capitol grounds. In his speech, Trump claimed election fraud and called on then-Vice-President Mike Pence to overturn the results.

The riot led to the biggest police investigation in US history with hundreds of people accused of criminal offences.

Ramaswamy said he will end the weaponisation of police power in America and noted that every Republican candidate must be clear on hard issues.
