Delhi court remands AAP MP Sanjay Singh to ED custody till October 10 in Delhi Excise Policy case

A Delhi court on Thursday remanded Aam Aadmi Party (AAP) Member of Parliament (MP) Sanjay Singh to Enforcement Directorate (ED) custody till October 10 in the case related to the Delhi excise policy scam.

Special judge MK Nagpal passed the order after ED sought 10 days of custody of Singh.

The counsel appearing for the ED argued that an amount of about ₹ 2 crores was exchanged at Singh’s residence.

“Total 2 crore transaction is there in two tranches … Dinesh Arora’s CA confirmed this … Total 239 places searched, sir. Investigation has revealed that 2 crore cash was given,” the ED submitted.

The ED counsel added the agency needed custody over Singh to confront him with digital evidence, including evidence from his phone.

Meanwhile, Senior Advocate Mohit Mathur appeared for Singh and opposed the ED’s plea for 10 days’ remand.

“Ten days is an absurd proposition for someone who was not involved at all. The case was about liquor policy, he had nothing to do with it,” Mathur argued.

The senior lawyer questioned the basis on which Singh was arrested in the case, contending that an approver, Dinesh Arora, may have implicated the AAP leader to secure his (Arora’s) liberty.

“Look at the changing stand of Dinesh Arora. He gives statements in March and April. He was granted bail and then his tune changes …You don’t want to call me for investigation. You want to humiliate me by arresting,” Mathur argued.

In rejoinder submissions, the ED opposed Mathur’s claim that Arora may have been forced to implicate Singh in the case.

“The argument that Dinesh Arora gave the statements on inducement is completely baseless. They can’t dictate where they are arrested either. It is the sole discretion of the IO,” argued Special Counsel Zoheb Hossain.

In a move that was objected to by the ED, Sanjay Singh also personally addressed the court, questioning why the approvers had decided to implicate him out of the blue.

“Itna unknown aadmi to mai hu nahi ki usko mera naa yaad nahi aaya. Dinesh Arora ko bhi mera naam yaad nahi aaya. Achanak aesa kya hua ki usne saara bayan mere khilaaf diya. Ye jhhut failana, bebuniyaad investigation karna… agar meri galati hai to mujhe sakht se sakht saza de … Main to bas itna hi kehna chahta hu ki mere liye koi alag kanoon nahi ho sakta … Aap nyay ki kursi par hain, sir.”

(Translation: I am not so unknown that he (Amit Arora) did not remember my name while giving earlier statements. Dinesh Arora also did not remember my name. What happened suddenly that he gave all the statements against me? They are spreading lies and this investigation is baseless. If I am guilty, give me the harshest punishment. All I want to say is that there cannot be a different law for me. You are sitting on the chair of justice, sir.)

The Rajya Sabha MP was arrested by ED on October 4 following the Central agency’s search at his residence.

This is the third high-profile arrest of the AAP leader in the excise policy case. AAP communications in-charge, Vijay Nair, was arrested in September 2022. Later, former Deputy Chief Minster of Delhi and AAP leader, Manish Sisodia was arrested in February 2023. Both the leaders are still behind bars.

Singh’s arrest came a day after the Court allowed businessman Dinesh Arora and Raghav Magunta Reddy (both of whom were accused in the case) to become approvers.

It is the ED’s case that Singh played a key role in framing and implementing a now-scrapped Delhi liquor policy which was allegedly aimed at benefiting certain liquor manufacturers, wholesalers, and retailers.

SEC tries to force Musk to testify in Twitter takeover probe

Elon Musk, the world’s richest man, is being sued by the U.S. Securities and Exchange Commission, which is trying to compel him to testify as part of a probe into his $44 billion takeover of social media giant Twitter, a Thursday court filing showed.

The investigation, which escalates a long-running feud between the SEC and Musk, concerns whether Musk broke federal securities laws in 2022 when he bought stock in Twitter, which Musk renamed X, as well as statements and SEC filings he made in relation to the deal.

The SEC in May 2022 said it was looking into Musk’s disclosure of his stake in Twitter, questioning whether he filed the appropriate paperwork.

The SEC in Thursday’s filing said it subpoenaed Musk in May 2023 requiring him to provide testimony at the SEC’s San Francisco office, and that Musk had agreed to appear on Sept. 15. But then two days beforehand Musk raised “several spurious objections” and told the SEC he would not appear, the SEC said.

Musk also refused SEC proposals to conduct the deposition in Texas in October or November.

Among his objections was that the SEC was trying to “harass” him and his counsel needed time to review potentially relevant material contained in a biography of Musk published last month, the SEC said.

According to the filing, Musk has given the SEC documents relating to the probe and has previously provided testimony in July last year via video conference.

“The SEC has already taken Mr. Musk’s testimony multiple times in this misguided investigation – enough is enough,” said a statement from Alex Spiro, an attorney for Musk.

In a press release, the SEC said it was seeking “Musk’s testimony to obtain information not already in the SEC’s possession that is relevant to its legitimate and lawful investigation.” An SEC spokesperson declined to comment further.

Musk acquired Twitter after initially building a large minority stake in the social media platform, which he first disclosed in April 2022. Musk was late with the disclosure filing and initially indicated he planned to be a passive stakeholder, meaning he did not plan to take over Twitter or influence its management decisions.

Days later, Musk accepted and then turned down a board seat at Twitter. In late April, he announced plans to buy the company for $44 billion but subsequently tried to get out of the deal, alleging Twitter was not disclosing the full extent of bot activity on its platform.

Faced with a trial that sought to compel him to complete the deal, Musk closed his acquisition of Twitter in late October 2022.

Delhi Excise Policy: Sanjay Singh Arrested After ED Raids, Questioning; AAP Vows to Fight Legally

Aam Aadmi Party (AAP) MP Sanjay Singh was arrested after the Enforcement Directorate raided his premises in connection with the Delhi excise policy-linked money laundering case on Wednesday. Singh, 51, is the third AAP leader who has been arrested.

The ED raids began before 7 a.m., when the MP was home with his wife, parents, domestic help and his pet dogs, fish and birds. The ED raids came months after the agency raided three of his associates — Sarvesh Mishra, Ajit and Vivek Tyagi – over their alleged involvement in the purported Delhi liquor scam.

Meanwhile, Delhi Chief Minister Arvind Kejriwal said the BJP is resorting to desperate measures as it stares at a defeat in the 2024 Lok Sabha elections, which is why many such raids will take place as the polls come closer.

Kejriwal, who visited Singh’s residence in the night, said agencies have conducted thousands of raids but they did not find any money.

“They (ED officials) searched his entire house but nothing was found and he was arrested in the evening. Elections are coming and after the formation of the INDIA alliance, PM Modi is desperate… They will arrest many people till 2024. Sanjay Singh is a lion…We file a case in court,” he said.

Hundreds of AAP workers gheraoed Singh’s residence as he was arrested by the ED.

On Sanjay Singh’s arrest, his father said, “We’ve said we will cooperate. I told him (Sanjay Singh) not to worry. I think they didn’t find any base to arrest him but since they (ED officials) were told to arrest, they arrested him. It will bring positive results as the government will be changed.”

The Member of Parliament’s wife said ED officials have not found anything and they were under pressure to arrest Sanjay Singh. They have no grounds of arrest, she said.

US accuses Google of illegal methods to push up ad prices

A lawyer for the U.S. Justice Department pressed a Google executive on Wednesday about techniques the search and advertising giant used to push up online advertising prices in an allegedly unfair way.

Testifying at a once-in-a-generation antitrust trial in Washington where the United States has accused Google of abusing its dominance of search and some advertising, Google executive Adam Juda said the company uses a formula, which includes the quality of an ad, to decide who wins auctions that are used to place advertising on websites.

The Justice Department has accused Google of manipulating online auctions – a multibillion dollar industry dominated by Google – with these formulas to favor its own bottom line.

Justice Department attorney David Dahlquist asked Juda if he agreed with a document that Google had prepared for the European Union, which said that the company can “directly affect pricing through tunings of our auction mechanisms.” Juda said he did not.

Pressed on if “tuning” can impact pricing, Juda said, “They can.” Juda’s testimony began on Tuesday and continued into Wednesday.

Juda said one thing that can be “tuned” is a rough formula that gives an ad a long-term value, or LTV, based on the bid given, the potential click-through rate or how many people will likely click on it and the quality of the advertisement and website associated with it.

Karnataka News: FIR filed against 3 female paramedical students, college in Udupi for filming fellow in washroom

An FIR has been registered against three girl students of a paramedical Netra Jyothi College in Udupi over the alleged recording of a video of their fellow student in the college washroom

Karnataka college students were suspended after it was reported that they were allegedly taking videos of a fellow student in the restroom. The three students were all female and studied optometry in Netra Jyothi College in Udupi, Karnataka.

Netra Jyothi College director Rashmi Krishna Prasad said the incident occurred on Wednesday and the students were suspended the very next day.

The matter came to limelight when the victim of the paramediacal college in Udupi informed her friends about the unconsented filming the three female students indulged in, and the friends informed the management.

The three students, Shabhnaz, Alfiya and Aleema, have been named in an FIR.

According to the college authorities, the three now suspended female students had told the victim, that their target was some other girls and she was mistakenly video graphed. They reportedly deleted the video in front of the victim.

The three female students from the Udupi college were suspended on two counts — first, they brought mobile phone which is banned in the college and then for taking video, she said.

“We suspended the three girls immediately. Though the victim was reluctant to lodge a police complaint for some reason, we petitioned to the police informing them about the incident. We also handed over the mobile phones used in videography for forensic examination,” Rashmi told news agency PTI.

An FIR has been registered against three girl students of a paramedical college in Udupi over the alleged recording of a video of their fellow student in the college washroom recently, police sources said. The FIR has been filed at Malpe police station in Udupi.
