Prime Minister Lauds Supreme Court & CJI For Making SC Data Available On National Judicial Data Grid

The Prime Minister of India Narendra Modi lauded the Supreme Court and Chief Justice DY Chandrachud for the onboarding of the Supreme Court data on the National Judicial Data Grid (NJDG). Stating that the harnessing of technology would further transparency, the Prime Minister took to his twitter account to state–

Laudatory step by the Supreme Court and CJI DY Chandrachud Ji. Such harnessing of technology will further transparency and enhance the justice delivery system in our country.

This morning, the CJI had announced that the Supreme Court is officially ‘onboard’ with the National Judicial Data Grid (NJDG) now. The CJI described the onboarding of the Supreme Court data on NJDG portal under the court’s ‘open data policy’ as a step “to bring transparency and accountability in the judicial domain.

Supreme Court Collegium Recommends Transfer Of Three Calcutta High Court Judges

The Supreme Court Collegium, in its meeting held on 3 August 2023, has recommended the transfer of 3 Calcutta High Court judges.

The Collegium, consisting of Chief Justice of India Dhananjaya Y Chandrachud, Justice Sanjay Kishan Kaul, Justice Sanjiv Khanna, Justice B R Gavai and Justice Surya Kant, has recommended the names of the following 3 judges of the Calcutta High Court:

Justice Shekhar B. Saraf (Proposed to be transferred to Allahabad High Court)

By a letter dated 7 August 2023, Justice Shekhar B Saraf accepted the proposal for his transfer, however, he requested a reconsideration of the proposed transfer and in the alternative, requested to consider transferring him to any of the places i.e. Delhi, Hyderabad, Bangalore and Chandigarh.

However, the Collegium did not find any merit in the requests made by him and therefore, it resolved to reiterate its recommendation to transfer him to the Allahabad High Court.

Notably, Justice Shekhar B Saraf had recently delivered a scathing judgement against Indian Railways officials due to their ‘fraudulent’ conduct in arbitration proceedings, as well as another judgement against the lack of accountability between Government officials.

‘Once We Cease To Be Judges, Whatever We Say Are Opinions, They Aren’t Binding’ : CJI DY Chandrachud On Ranjan Gogoi’s ‘Basic Structure’ Comment

The statement made by former Chief Justice of India Ranjan Gogoi in Rajya Sabha yesterday doubting the basic structure doctrine came up for discussion before the Supreme Court during the hearing of the Article 370 case.

Addressing a Constitution Bench, Senior Advocate Kapil Sibal, arguing for the petitioners, contended that the manner in which the Centre abrogated the special status of Jammu and Kashmir cannot be justified “unless a new jurisprudence comes to light that they can do whatever they like as long as they have majority”.

In this context, Sibal further said, “now one of your esteemed colleagues has said that in fact basic structure theory is also doubtful”.

Responding to Sibal, Chief Justice of India DY Chandrachud, after taking a moment’s pause, said, “Mr Sibal, when you refer to a colleague, you have to refer to a sitting colleague. Once we cease to be judges, whatever we say, they’re opinions, they are not binding”.
