Biden administration takes abortion pill dispute to US Supreme Court

REUTERS/Evelyn Hockstein/File Photo Acquire Licensing RightsPresident Joe Biden’s administration took its battle to preserve broad access to the abortion pill mifepristone to the U.S. Supreme Court on Friday as it appealed a lower court’s ruling that would curb how the drug is delivered and distributed.

The Justice Department said it filed its appeal of an August decision by the New Orleans-based 5th U.S. Circuit Court of Appeals that would bar telemedicine prescriptions and shipments of mifepristone by mail. The drug’s manufacturer, Danco Laboratories, also said it filed its appeal on Friday.

The 5th Circuit’s decision is currently on hold pending the outcome of the administration’s appeal at the Supreme Court.

The Justice Department in its filing said that allowing the 5th Circuit’s restrictions to take effect would have “damaging consequences for women seeking lawful abortions and a healthcare system that relies on the availability of the drug under the current conditions of use.”

The case could put at risk the authority of the U.S. Food and Drug Administration (FDA), the federal agency that signs off on the safety of food products, drugs and medical devices. The FDA approved mifepristone in 2000.

In its filing, Danco’s attorney Jessica Ellsworth said the 5th Circuit upended the approved conditions for use of Danco’s drug, called Mifeprex, “at the request of a group of plaintiffs who do not prescribe or use the drug and whose real disagreement with FDA is that they oppose all forms of abortion.”

If the justices decide to take up the case, they could hear arguments in their next term, which begins in October, and issue a ruling by the end of June 2024.

The 5th Circuit’s decision partially sided with the anti-abortion groups and doctors who challenged mifepristone. It did not go as far as a prior decision by U.S. Judge Matthew Kacsmaryk in Amarillo, Texas, that would have suspended FDA approval of mifepristone and effectively pulled it off the market.

In April, the Supreme Court granted emergency requests by the Justice Department and the pill’s manufacturer Danco Laboratories to put on hold Kacsmaryk’s order while litigation continued.

Biden admin asks New York private businesses to help migrant crisis — by offering free services

The Biden administration again shunted the responsibility of New York’s spiraling migrant crisis — this time by telling the Empire State’s private businesses to step up while it offers a measly $600 million to offset the multi-billion dollar crisis.

The proposal put forward by White House officials in a meeting with Gov. Kathy Hochul Wednesday suggested putting out a call to city companies to provide free services to the asylum seekers, including pro bono legal advice, The Post learned Thursday.

The request for handouts also extends to free help educating and consulting migrants on how to apply for work permits.

Meanwhile, the Biden admin said it would ask Congress for $600 million to help New York feed and house the crush of migrants arriving in the Big Apple under the president’s soft border policies.

Even if the Big Apple gets the paltry amount from the feds, the overall tally would be $746 million — just a fraction of the $5.2 billion already spent to care for the more than 107,000 asylum-seekers that have arrived from the southern border since spring 2022.

Mayor Eric Adams has also already warned the crisis could cost the city an eye-watering $12 billion by 2025.

The new strategy from the federal government — a slap in the face to NYC’s business community that demanded Biden take ownership of the immigration crisis — emerged just hours after Hochul trekked down to DC on Wednesday to meet with the president’s chief of staff, Jeff Zients.

The governor claimed she came out of Wednesday’s meeting “with a sense they are committed” after being promised a “surge of resources” into the city over the next couple of weeks.

“They understand that a lot of time has passed and that this situation has only grown more dire,” the governor told NY1.

The proposal also came just days after the White House scoffed at the notion it is to blame for the influx, saying the Big Apple’s and state’s own issues caused the catastrophic mess.

New York City is currently caring for nearly 60,000 asylum seekers — and thousands of migrant kids are expected to start attending public school on Sept. 7, according to the Department of Education.

The flood continues to cripple the Big Apple’s resources, with officials scrambling to find places to house the roughly 3,000 migrants that have arrived each week recently, according to City Hall officials.

Meanwhile, New York City is still waiting for the “liaison” — a point person between the federal Department of Homeland Security and Mayor Adams’ administration promised during Hizzoner’s trip to Washington, DC on July 27.

Gun industry cries foul after hundreds of gun dealers lose licenses amid Biden administration crackdown

A Biden administration crackdown has reportedly resulted in hundreds of gun dealers losing their licenses which has sparked anger and the belief by the dealers that they are being targeted.

During the last fiscal year that started in October, 122 gun dealers had their licenses revoked by the Bureau of Alcohol, Tobacco, Firearms and Explosives which is up from 90 the year before and 27 in 2021, Wall Street Journal reported.

During the Trump and Obama presidencies, the number of licenses revoked never exceeded 81.

Some in the gun industry are crying foul and suggesting that they are being unfairly targeted for political reasons over paperwork errors as part of an agenda to combat gun violence which President Biden has vocally pushed.

“We were making $1 million a year, now it’s less than $100,000,” Anthony Navarro, a gun dealer who lost his license last year after receiving three warnings for legal violations since 2009, told Wall Street Journal. “This policy is designed to be a backdoor violation of the Second Amendment.”

Navarro said he was issued warnings over mistakes gun purchasers made on paperwork but that they weren’t prohibited from buying guns.

Others have pointed out that gun dealers are typically strong allies of the federal government in terms of providing tips on suspicious gun buyers and that the working relationship could be harmed by the crackdown.

“The gun dealers were our first line of defense against gun trafficking,” Peter Forcelli, a retired deputy assistant director, told Wall Street Journal. “Why are we now beating an ally into submission?”

In a statement to Fox News Digital, the ATF said it is following the law.

“Federal Firearms Licensees are often our first line of defense against gun crime and are often a source of critical enforcement information that helps law enforcement identify straw purchasers and disrupt firearms trafficking schemes,” ATF Spokesperson Kristina Mastropasqua said. “FFLs that willfully violate the law, however, must be held accountable. ATF conducts inspections to ensure compliance with applicable local, state, and federal laws and regulations and to educate licensees on the specific requirements of those laws and regulations.”
