Anantnag Encounter Ends After 7 Days, LeT Commander Among 2 Terrorists Killed

An LeT commander among two terrorists has been gunned as the fierce military operations spanning a week’s time came to an end on Tuesday.

After a fierce gunfight that continued for a week, an LeT commander was gunned down among the two terrorists neutralised in one of Jammu and Kashmir’s longest anti-militancy operations that has claimed the lives of three officers and a soldier. While the body of LeT commander Uzhair Khan has been recovered, the body of the other is yet to be found and a search is on for the same. Top police officer Vijay Kumar has also advised the public to not go into the affected area.

“The search operation will continue as many areas are still left…We would appeal to the public to not go there…We had the information about 2-3 terrorists. It’s possible that we find the third body somewhere that’s why we will complete the search operation. We found the body of the LeT Commander and retrieved it, we could also spot another body…We’re looking for the third body,” ADGP Kashmir Vijay Kumar on anti-terror operation at Anantnag.

Colonel Manpreet Singh, commanding officer, of 19 Rashtriya Rifles, Major Ashish Dhonchak and Deputy Superintendent of Jammu and Kashmir Police Humayun Bhat lost their lives last Wednesday.

Body Of Missing Soldier Found After 6 Days
Two bodies were found in the dense forest region of the Gadole region on Monday, one of which was of a soldier who went missing last Wednesday during an encounter with militants. The identity of the other is yet to be ascertained, said an official while talking to the news agency PTI. Police officials have received information that two to three terrorists are trapped in the forest area.

The security forces are using drones and helicopters for surveillance of the dense forest area with several cave-like hideouts where the terrorists are believed. During the search, drone footage showed a charred body near one of the terrorist hideouts that was destroyed during the operation. Several cave-like hideouts are being examined where terrorists are believed to have been holed up since Wednesday.

The search was extended to the neighbouring area of Posh Kreeri on Sunday as a precautionary measure in order to ensure that the terrorists don’t slip into the civilian areas, reported PTI.

J&K: 48 Hrs Later, Encounter Still On; 2 Army Officers, 1 Cop Dead In Anantnag Operation

At least two more Army officers have been injured in the encounter which is underway in Kokernag in Jammu and Kashmir’s Anantnag district since early hours on Wednesday. Two army officers and a Deputy Superintendent of Jammu and Kashmir died in a fierce gunfight between security forces and terrorists on Wednesday.

Their deaths came less than 24 hours after another Indian Army jawan and an Army dog were gunned down in Rajouri.

The army and the police launched a joint search operation to hunt down the terrorists late at night on Tuesday.

As per media reports, the General-Officer-Commanding (GOC) of the Chinar Corps, Lt General Rajiv Ghai, and the GOC of the Victor Force, Maj General Balbir Singh is currently monitoring the operations.

CNN-News18 earlier reported that terrorists are now equipped with YSMS technology, which was used earlier in deadly attacks of 2016 and 2019.

So far, four security forces personnel — Colonel Manpreet Singh, Commanding Officer of 19 Rashtriya Rifles, Major Ashish Dhonack, and Deputy Superintendent Humayun Bhat, and rifleman Ravi Kumar- have been killed in the gunfight with terrorists. They are believed to be have been killed by Lashkar-e-Taiba (LeT) terrorists.

2 Army Officers, Policeman Killed In Action In Kashmir, Encounter On

Colonel Manpreet Singh, Major Aashish Dhonchak and Deputy Superintendent of Police Himanyun Muzamil Bhat were killed in action during the gunfight.

A colonel, a major of a Rashtriya Rifles unit of the army and a Deputy Superintendent of Jammu and Kashmir Police were killed in action during an encounter with terrorists in Jammu and Kashmir’s Anantnag district, officials said.
Colonel Manpreet Singh, Major Aashish Dhonchak and Deputy Superintendent of Police Himanyun Muzamil Bhat were killed in action during the gunfight. Colonel Manpreet Singh was the commanding officer of the 19 Rashtriya Rifles (19 RR) unit and is a recipient of the prestigious Sena Medal (SM).

Rashtriya Rifles is the counter-insurgency force of the army that operates in Jammu and Kashmir.

Article 370 case: Integration of Jammu and Kashmir with India was not conditional but absolute, says Supreme Court

Senior Advocate Zaffer Shah said that Article 370 has nothing to do with national security or law and order problems in the State.

In no way was the integration of Jammu and Kashmir (J&K) with India in 1948 conditional, the Supreme Court said on Thursday while hearing the batch of petition challenging the abrogation of Article 370. [In Re: Article 370 of the Constitution].

A Constitution Bench of Chief Justice of India (CJI) DY Chandrachud and Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai and Surya Kant underlined the integration of J&K with India was absolute.

This was in response to the argument of Senior Advocate Zaffar Shah that if the Government of India wanted to ‘completely integrate’ the erstwhile State with the Union of India, then a merger agreement should have been executed as it happened with other princely States.

CJI Chandrachud then remarked,

“One thing is very clear that the there was no conditional integration of Jammu and Kashmir with India. The integration was absolute and complete in every which way. So the only question which remains in a limited sense was if Parliament could exercise the power etc. Take the case of an Indian State apart from J&K. There are restraints on the power of parliament to make laws for any States for subjects on State lists. Distribution of the legislative powers does not impact sovereignty of India.”

Today was the fifth day of the hearing in the case.

The matter is being heard nearly four years after the Central government’s move in August 2019 that resulted in the revocation of the special status of Jammu and Kashmir (J&K).

The erstwhile State was subsequently bifurcated into two Union Territories.

The Union Home Ministry recently filed an affidavit before the Court stating that after the abrogation of Article 370, Jammu and Kashmir has witnessed unprecedented stability and progress, with stone pelting and school closures becoming a thing of the past.

Senior Advocate Zaffar Shah argued today on behalf of the Jammu & Kashmir High Court Bar Association.

He set out the historical context behind Article 370.

“Why was J&K special? It was because there was no merger agreement and the State had to maintain a constitutional autonomy. We are here before this court because we believe that J&K has constitutional autonomy and this autonomy comes from the instrument of accession and Article 370. President and Union can make laws for any state in the country without their view but not for Jammu and Kashmir,” he stated.

Justice Kaul opined that to view Article 370 as unamendable might have dangerous implications.

“To say that Article 370 is such that it can never be amended is a dangerous thing to say. State assembly could have also said that let all provisions of the Constitution apply to J&K using Article 370. Except 370 remains a skeleton, everything else applies. Even now in the sense Article 370 is not removed, whatever was there in Article 370 has been removed using the machinery of Article 370 itself. Does it not all come down to one thing – whether the process followed was flawed or not is the question here?”

Justice Khanna then asked whether the Indian Constitution was supreme or the Instrument of Accession executed between the Government of India and Maharaja J&K by which J&K became a part of India.

“Of course the Constitution of India is supreme but with Article 370 in it,” replied Shah.

The CJI said that requirement to have concurrence of the State is not something unique to J&K laws.

“See Article 248. Parliament can make laws even on area which is in State list only, but it requires concurrence of the concerned State. But this does not impact the sovereignty of the Union,” the CJI underlined.

Shah replied by saying that the J&K was only seeking to reclaim its constitutional autonomy that had been snatched away.

Search operation under way in J&K’s Kulgam for terrorists who killed 3 soldiers

Security forces launched a massive search operation on Saturday to trace a group of terrorists who killed three Army personnel during an encounter a day earlier in Jammu and Kashmir’s Kulgam district, officials said.

Friday’s encounter between security personnel and the terrorists occurred in the higher reaches of the Halan forest area of Kulgam in south Kashmir.

The gunfight ensued after the terrorists fired upon a security forces party, which had erected a tent in the area as part of an area domination exercise, the officials said.

In the exchange of fire, three Army personnel were injured. They died later during treatment. The terrorists subsequently decamped with some weapons, the officials said.

India on Wednesday reiterated that Jammu and Kashmir is an internal matter and said it rejects the “uncalled reference” to it by the Chinese Foreign Minister Wang Yi during his speech at a function in Pakistan. “Matters related to the Union Territory of Jammu and Kashmir are entirely the internal affairs of India. Other countries including China have no locus standi to comment. They should note that India refrains from public judgement of their internal issues,” ministry spokesperson Arindam Bagchi told reporters today in response to queries on the Chinese Foreign Minister’s speech.

Mr Wang had made a reference to Kashmir in his opening speech at the Organisation of Islamic Cooperation in Pakistan. “On Kashmir, we have heard again today the calls of many of our Islamic friends. And China shares the same hope,” he had said.

New Delhi’s rejection of Wang Yi’s comments came in the midst of hectic consultations between the two sides over a possible visit by him to New Delhi within two days.

China has time and again reiterated its support to the stand of Pakistan — its strategic ally — on the matter of Jammu and Kashmir.
